Food Regulations Offences

If you run a busy shop or other commercial concern dealing with the production, processing, handling, temperature control, labelling or sales of foodstuffs then you will be only too aware of the spot checks, test purchases and other investigations that can be carried out by Environmental Department Food Safety Officers.

Even if your business involves merely transport, storage and the attendant cleaning of areas where food transits then you are exposed to a potential liability under the following;

Health and Safety at Work Act 1974

Food Safety Act 1990

By rendering food injurious to health, by producing food not of a nature or substance or quality demanded, or having falsely or misleadingly described or presented goods.

Food Safety (General Food Hygiene) Regulations 1995

Food Standards Act 1999

The combination of Acts above are variously enforced by Local Councils, Environmental Health Officers (EHO) and Trading Standards Officers as well as the Food Standards Agency. They may enter your premises, take samples for micro-bacteriological analysis and ultimately bring a prosecution. The sanction of the courts is inevitably a fine often of a size to act as a deterrent to others.

Even if a statutory defence is not available to you, a well presented plea in mitigation after a guilty plea may result in a significant financial saving to you and your business enabling you to return to trading with the minimum of disturbance to your income stream.

An alternative to an 'improvement order' and prosecution is that of a 'prohibition order' or a 'control order' (effectively closing the business).
